we're watching the developments on capitol hill on the fiscal cliff deal. 12 hours ago, 14 hours ago rather, 2:00 a.m., the senate passed a bill, 89-8 in the bipartisan fashion. then was sent over to the house. it was hopeful that the house would then take that bill and agree to it, that it would pass with 218 votes, and then perhaps it would become law and the fiscal cliff deal would be done. however, we've just learned within the last 30 minutes that the second ranking republican in the house does not support the bill as it stands. and as our luke russert has been reporting to us, this would mean a whole other round of amendments perhaps to that bill. it also could mean that, therefore, it would go to the senate and then back to the house. this as we look at only 44 hours left in the 112th congress, and can they get it done or will it have to start all over again on thursday with the 113th congress? nbc's luke russert has been reporting for us and he was speaking with members early and heard from one member, luke, and i found this very interesting, you said that that member told yo

it would be a package to deal with averting the fiscal cliff. we can infer from that with what the president said before he went to the family vacation in hawaii that he wanted something that would be scaled down, not a massive grand bargain that would protect the current tax rate for people who earned less than $250,000 a year or perhaps a different figure if they reached that. but trying to protect the middle class. so officials here haven't seen it yet, but this is kind of today's volley in what has been this ongoing battle. house speaker john boehner has been saying the president must act and it appears the president is prepared to do that with another offer. and senate democrats would presumably be right on board with that. hopefully we will get details sometime this afternoon. then we'll see where we are. there isn't much time left. as you know, there are many people who have sorted of scaled back the breathless approach to what is a fiscal cliff and are a little bit more low key about it now. obviously, there are deadlines. but if it goes

the fiscal cliff. what do you think are the dynamics operating there, including senator mcconnell's position. >> he has three choices here, he can find a couple votes to help harry reid get to 60 so they can help a small piece through. he can say, look, do it yourself, we're not going to filibuster it, so you can pass with just the majority only, and then you own all the responsibility for this. or he can simply do nothing. and at this point he's choosing the do nothing route. i don't know how long that's going to last. i think boehner gave a hint of a little openness to something in his statement he put out today. in the very end he said, we passed a bill, the senate doesn't like it, they should amend it, send it back and we will vote on it. that's a commitment from him. if the senate takes up the house bill, amends to do exactly what reid wants, then you have a commitment for boehner to vote on it. it will pass, because there are enough democrats that will meet with republicans to pass it. >> ryan gr
